That depends greatly on the state. In Texas, possession of marijuana punishment is dependent on the amount (based on ounces), and Texas does not have a possession with intent to distribute for marijuana. I believe many other states to increase the punishment for intent to distribute even with marijuana. I would suggest you look to the penal code of your state, or possibly re-post the question to include the state.
Marijuana and weed are the same thing. And almost everybody knows that is is illegal to be in possession of marijuana without a medical permit, which can only be approved in 15 different states and D.C.

While these states have declared they won't prosecute the possession or use of marijuana, so long as a certain set of circumstances exists, marijuana is still illegal under federal law. When you cross state lines with it in your possession, you're entering fed territory, and trafficking is a federal felony.
