Depends on the departments policy there all different some do but most do not for example some city departments or sheriff departments can smoke but i know that state troopers are not allowed to use tobacco products on or off duty I checked a few state police websites and one of the qualifications was use of all tobacco products on or off duty was strictly prohibited
