As my EMS Chief says the man with the Gun is in charge... when it comes right down to it, it is the polices job to enforce the laws. This said it is up to the police how to enforce the law so they are your patient and you can ask the police for things (generally they will be doing what they can to help you) but as far as whos scene theirs, whos patient the EMTs.
