US Supreme Court Chief Justice John G. Roberts administered the Oath of Office to Barack Obama -- twice. Roberts made some errors in reciting the Oath at Obama's inauguration on January 20, 2009, so they repeated the ceremoy the next day to unsure no one challenged the constitutionality of Obama's Presidency or decisions on the basis of the error.

The Chief Justice traditionally administers the Oath to the incoming president, although this is not mandated by the Constitution or federal law. Sarah T. Hughes, a U.S. District judge, swore in Lyndon B. Johnson aboard Airforce One following the assassination of President Kennedy.

On May 26, 2009, President Obama announced that he had nominated federal Circuit judge Sonia Sotomayor, an Hispanic woman with extensive judicial experience, to replace Justice David H. Souter, who retired at the end of June 2009.

Under the rules of the Constitution, the President can nominate whomever he chooses as a Supreme Court Justice, but that person is simply a candidate for the office until the Senate votes whether to confirm the nomination and appoint, or commission, the person as a Justice.

In mid-July, Sotomayor underwent intense questioning by the Senate Judiciary Committee, the members of the Senate charged with the responsibility of determining whether the nominee should be recommended for approval or rejection when the full Senate votes. Occasionally, the Judiciary Committee is unable to reach consensus and sends the vote to the floor with no recommendation (this is what happened with Justice Clarence Thomas).

On July 28, 2009, the Senate Judiciary Committee announced it had voted 13-6 in favor of Sotomayor, with just one Republican, Senator Lindsey Graham (R-SC), casting a ballot in her favor. As expected, the decision was otherwise split down party lines.

On August 6, 2009, the US Senate confirmed Sotomayor's nomination by a vote of 68-31, making her the 111th US Supreme Court Justice. Although the vote was split along party lines, the unanimous Democratic endorsement was joined by nine Republicans and both Senate Independents.

Associate Justice Sotomayor took the Constitutional and Judicial Oaths of Office on August 8, 2009.

No one else. Only Chief Justice Roberts administered the Oath of Office to President Obama. Senior Associate Justice John Paul Stevens, who retired in June 2010, administered the Oath to Vice-President Biden.

John Roberts is the Chief Justice. He was not appointed by Obama. Supreme Court justices are appointed for life and do not change because the administration changes.
