If you're referring to President Andrew Johnson, no one killed him. He was Abraham Lincoln's Vice-President, and assumed the office of President after Lincoln was assassinated by John Wilkes Booth in 1865. Andrew Johnson died of a stroke in 1875.

George Atzerodt was supposed to kill Vice President Andrew Johnson, He lost his nerve and got drunk in a bar instead. That didn't save him, however, since he was hanged along with the others.

He was probably hanged illegally, as was Mary Surratt, whose crime seemed to be comprised of aiding and abetting. However, at the time the country was in no mood to consider fine points, and the federal government had to make a strong showing of being in charge for Propaganda purposes.

Any show of weakness might have encouraged more uprisings in the South.
