Lee was defeated by the Army of the Potomac, commanded by General George Meade. But the Union General-in-Chief, U.S. Grant, was travelling with them in a mobile HQ, and it was Grant who took the surrender. Some said it should have been Meade.

Meade never surrendered. If he had done, it would have been to a Confederate. Meade was commander of the Army of the Potomac, and victor of Gettysburg, only days after being appointed Army commander. He continued in command until the surrender at Appomattox. Some say he should have taken Lee's surrender, as his opposite number. But Grant took the surrender, as General-in-Chief (also Lee's opposite number in that capacity). But at that rate, Lee should strictly have surrendered all Confederate forces, not just the Army of Northern Virginia.

Despite his failure in keeping Vicksburg from falling, Confederate General John C. Pemberton was not blamed for it by Confederate President Jefferson Davis. There was, however, no command available to him so he resigned. He remained loyal to the South, however, and the Pennsylvania born Confederate later accepted a commission of lieutenant colonel in the Confederate artillery and served there until the end of the war.
