This is due to EPA requirements making all enigines vent the crankcase gases through the carburetor to be burned. Unfortunatly, Harley Davidson designed the Sportster vent configuration through the heads and DOWN (gravity) into the carburetor. This setup allows raw oil to be pushed into the air cleaner at times (especially when the oil is hot and thin) and leak out the air cleaner and onto the bike, etc.

If the casing is spilt a filter will leak an incorrectly installed filter will also leak.

The oil filter is located in front of the front cylinder
PCV valve is shot. The oil leaks down the intake snorkle to the filter.
you probably have a little "blowby", where combustion gasses leak past the pistons and into the crankcase. When the gasses escape through the breather, into the air filter, any oil vapor that has been picked up is deposited on the air filter.

If it is a stock paper filter, no it needs replacing, if it is a k&n high flow, yes, clean it with k&n filter cleaner and rinse with gentle running water let it dry and oil the filter with k&n filter oil.

The filter cap will be brocken and oil can leak through that way just change the filter cap
It's in the area of the oil filter, wires going to it. Can leak but most of the time it's the gasket between the oil filter adapter.
