The brake switch may be bad or need to be adjusted. Pull up on the brake pedal and see if the lights go out. If so the switch needs adjustment. Get a flash light and lay on the driver side floor board and look up at the brake pedal. You should see a switch with a button on the end that touches the pedal arm. You can just twist the switch loose and lower it a little closer to the pedal arm and twist it back in place. You want it where when you barely push the brake pedal the lights will come on. It may take a couple of times of adjusting to get it right. It may have two of these switches. The other will be for the cruise control. To see which one is which just push down on the pedal and with the other hand push one of the buttons in to see which one is turning the brake lights on and off. If the switch is bad just twist and pull it out of the bracket and unhook the wires and replace.
