Because a new moon is between the sun and the earth. Therefore, we see the shaded side of the moon whch disappears during the daytime. A new moon can be seen with a very high power telescope, but not with the unaided eye.

there is a specific pattern of moon phases and the act of waning means decreasing so when the illuminated side of the moon is shown on earth and is decreasing to lead up to the new moon phase (where you cant see any thing in the sky)that is a waning moon.
