On June 26, 2003, the United States Supreme Court, in Lawrence v. Texas, ruled that the Texas statute which made consensual homosexual activity between adults a Class C misdemeanor was unconstitutional because it violated the Due Process clause of the U.S. Constitution. Since that date, the Texas sodomy law, as well as that of any other state, cannot be enforced. The Texas Legislature, however, has yet to repeal the statute, perhaps as a sign of defiance against the federal government. Nevertheless, that statute is null and void.
