In order to properly understand the answer to this question we must first remember the era in which the idea of the judiciary was established. we were trying to replace the articles of confedteration which was an extremely flawed document with no justice system, and the constitution itself was a document that many believed would not survive more than twenty years. Yet our founding fathers knew that in order to make this document survive there would have to be a group of people whose sole purpose was to interpert the meaning behind the words that had been written. The uses of the national judiciary have been seen time and time again as two individaul can read the same words from our constitution and see several different meanings. The only way to ensure that the document would be understood and honored in the way that our founding fathers intended was to establish this branch of government.
The Federalists, including framers, saw a need for national judiciary because they wanted to increase the power of the central government. They fought for a uniform set of laws.

No. Chief Justice Marshall declared Section 13 of the Judiciary Act of 1789 unconstitutional, but that was just a small portion of the Act. The Judiciary Act of 1789 was neither revised nor repealed. The Judiciary Act of 1801, passed during the final days of President Adams' administration, was repealed after Thomas Jefferson and a new Congress took office. Congress repealed the Act because it expanded the Federal court system in a way that allowed President Adams to ensure Federalist Party members dominated the Judicial Branch of Government. When the Judiciary Act of 1801 was repealed, the Judiciary Act of 1789 was temporarily reinstated. For more information, see Related Questions, below.
