It wasn't up to Madison because he was one of many. The constitution is a compromise document and the men who wrote it did it as a group. The Bill of Rights had to be written and then voted on by the states.
Patrick Henry demanded that the Constitution have a Bill of Rights before Virginia approve it. James Madison assured him they would be added in the form of amendments. With that, Virginia adopted the Constitution. James Madison and John Adams designed the Bill of Rights which are the first 10 amendments to the constitution.
Because they did not have enough time before to put it in.
The Federalists, including Alexander Hamilton and James Madison, wrote the Federalist Papers, which argued for ratification of the Constitution without a Bill of Rights. Anitfederalists also wrote papers in response-- they wanted a Bill of Rights to be added before the Constitution was ratified.1Comment
