There might be a reasonable question hiding somewhere behind the above, but frankly the best possible answer to the question as asked is "because it is."

If you could provide details as to why you would think that the formula should be the incorrect second one, we might be able to explain the flaw in the reasoning. If it's just that you find the second one to be somehow more aesthetically pleasing and symmetrical... sorry, that's not how chemistry works.
