Sony and PS3 can demand the game developer fix any game that freezes when playing because of problems. The games must always be developed within the consoles capability and that is why the MW3 and other Call of Duty Series games are different for the Wii than the PS3 Xbox 360 and PC. Games must work perfectly in the console that they were designed for or they must be fixed to do so.
A game can not be sold that does not work correctly without either a requirement for a total refund for the defective product or an update that changes the software and fixes the problem. It is considered a manufacturing defect for a game to freeze and not be able to finish playing.
