The Supreme Court of the United States (SCOTUS) is a secular body which should use the laws of the United States, not religious interpretations or traditions, to adjudicate cases brought to it. As a consequence the secular nature would allow it to be defined as "atheist" or non-religious. The is some latitude in this as cases based in common law often involve cultural memes which may represent religious points of views.
There is no Atheist on the US Supreme Court for the same reason that, at the time of writing this, there is no Protestant, no Muslim, no Buddhist, no Hindu, and no Wicca observer on the US Supreme Court; there simply has not been one who was appointed to this term. There is no reason or impediment to an Atheist serving on the US Supreme Court other than the possible prejudices of the President and Senators doing the appointing.
