It should be allowed because you are born either gay or straight. It's not a choice. Moreover, even if it were a choice, it is not a bad thing. It does not affect anyone negatively unless someone wants to be affected by it negatively.
There is nothing in the constitution of any democratic nation that criminalizes homosexuality. It is, in fact, legal to be gay. You may, in error, believe that the controversy over the gay marriage laws to mean that being gay is a crime. It is, in fact, not.
There has never been a "need" to make homosexuals or being gay "legal" in that way. there is a push, and a much long awaited prospect of same sex marriage in the United States. SO in short-,There is no legal "need" to ban, lift, or otherwise make being gay illegal or legal in the United States. It is not about if someone is gay or not, it is about being treated with equality.
