A finance company could settle the auto loan. You simply need to get in touch with the company and make an offer. Be sure to get any agreement in writing.

GOOD question. Read the contract. Were you in default of it?? Why didnt you TAKE the car back? Why did they have to come get it?
I suggest that you call the company and see if they made a mistake. If they saw they didnt then explain to them that you never got it. If they still continue to deny it, you can go threw all the trouble to sue them
if the company goes bankrupt or if the whole stock as a whole crashes then you would lose all your money or alot of it but if the single company is good in time you will get your money bank as long as the company didnt go bankrupt 1 stock company is very good if its a good company because its easy to manage it and learn about the ups and downs of it

Yes - unfortunately you didnt borrow a car, you borrowed money. Your car has depreciated faster than you have paid off your loan it is your responsibility to pay the rest not the finance companies.

I am the original author of the question....my car was repossesed and we made arrangements with the financing company to pay off the back amount due and re-finance the loan. We signed the contract and 3 business days after we signed it (before we could even pick the car up) their storage place auctioned off the car. It seems as if the finance company didnt get the release info to the place holding our car in time. What are my rights in CA now in either getting the car back or getting the finance company to write it off?
