By harrassing you, it can only be assumed that they are calling you multiple times per day. Or, that when they call you they are making outlandish threats against you, your family, and all of your personal safety. Or, that they are coming to your place of employment and pointing at you to identify that they are trying to collect a debt from you.
Unless you can show evidence that this agency is in violation of the FDCPA, and your state's collection laws, then no. The contact will stop only after you have paid the debt off, or seven years from the date of your last payment (in this case probably the resale of the repossessed car) has passed, or in the event the lender sues you ten years have passed from the date of the judgment, or in the event the lender got an extension from the courts on the judgment tenty years from the original judgment date has ellapsed. Pay the outstanding amount that you contracted to pay, or keep getting phone calls.
You cannot stop the repo company from harassing you unless you pay your bill. The only thing you can do is try to ignore them.
yes it is an option for them
it will be on there as soon as the order gets sent to the repo company, they are the collection agency. after they repo ur car and it gets sold at auction ur credit score will change .
Are you talking about a collection agency? You need to consult an attorney on this, as statutes of limitations vary by state.
Jose. DID they repo the car?? If not, I dont see how it could be correct. Was this vehicle a repo at the time and were you paying the remaining balance to the collection agency or was the account a charge off? I am assuming that you are refering to Ford Motor Creit which I used to collect for. In most cases a 3rd party collection agency will purchase the account at pennies on the dollar or the account will be placed with a fee once the account is collected. It is the collection agency responsiblity to update the creditor of payments and in some cases update credit reports. Also it is a good idea to get a confirmed paid in full letter and to send it to the original creditor to make sure they update your credit report correctly.
Under the Fair Debt Collection Act the only information that a creditor is allowed to give anybody else is their name, and telephone number. If a repo company, which is a collection agency, gave any other information then you should consult an attorney and sue them.
yepAKA, the Fair Debt Collection Practices Act, nope. All a repo agency (or any other debt collector) can do is verify your employment and location. They CANNOT reveal ANY debt information (much less their intent to repo your vehicle) or even insinuate that you HAVE a debt. For more info on what a debt collector can and can't do, take a looksee at: http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf If a repo agency DID slander you to your employer, please take the time to complain about them ... they have invaded your privacy and stomped on your rights!!
The report will be removed 7 years after the date of the last on time payment to the original creditor.
The repo agency does one thing; repossess the vehicle. I don't know of any case where a lender could even draw from your pay. tThey hire a repo agency to get the vehicle, and they report your delinquency so your credit score suffers..The repo agency does one thing; repossess the vehicle. Many. Collection costs, storage, repo fees, etc.
Yes. However, the agency conducting the repo needs to be licenced to operate in the state you are in.
YOU HAVE TO CONTACT YOUR LENDER AND SEE WHAT THEY ARE WILLING TO DO. MOST WILL DEMAND FULL PAYMENT AND SELL YOUR NOTE TO A COLLECTION AGENCY AFTER YOU DO NOT PAY WHO WILL IN TURN GET A JUDGEMENT AGAINST YOU
