No, minecraft is already in Beta, and save files will not and aren't being deleted. I have a file from Alpha that is not deleted. :)
If you have a Alpha file in Beta mode, you will still receive the Beta updates.

Yes. The files save locally, and you can have multiple save files in one computer.
The Minecraft game can be played for free, as a beta version, on the Minecraft website. This version does not require the user to download any files.
Unless the download is hosted from Minecraft.net or a website that minecraft has given the writes to host the files is it legal.

All you need to do is paste the mod .class files and other needed mod files back in the jar file. This happenes because the .jar file is the file that gets deleted and replaced and e.g 1.4 mods are not compatible with 1.5 game so it helps to not crash the game.
Beta shop was deleted after the game was pronounced released. Although the shop was deleted, the Beta Berserker remains in game.

The regular download as of Minecraft 1.8 is the Beta Minecraft. The last Minecraft update I believe will be the "Final" product and official game and no longer be a game in Beta.
When the full Minecraft game is released you will have it if you buy the beta.
