Was he convicted as a result of allegation made during the divorce and involving a custody challenge? ---- I'm assuming you're talking about him not signing divorce papers. I don't know what state you're in, but in California, where they have "no-fault" divorces, you don't have to have him agree to the divorce. You need to have the papers all served on him properly, but that's easy because you know right where he is. You can have the sheriff's office do it. If there are more complications I didn't recognize, just copnsult a family law attorney for some advice.

Answer What I know about divorce papers is that they require two signatures, one from you the other from your husband, and if he doesn't sign the divorce papers, it doesn't matter he is no longer in the State where you live, if he doesn't sign the papers you can't get your divorce. There is also common law marriages where two people can live together for as long as they want and divorced or not, you can still live with another man. There's no law against it.
Yes, if your are married filing jointly. No if your are married filing seperatly.
Then you're NOT divorced. Both husband and wife MUST sign the divorce papers for the disillusion of marriage to be legal.

No, you can sign papers at the age of 18
Yes you can. The process is different because one individual is incarcerated and would not be able to attend the court precedings. You can send the divorce papers to them through the mail yourself or have it sent through a lawyers office as legal mail. The incarcerated individual would then sign the papers and send them back so that your can file the papers with the court and get your divorce.
