What if you buy a car from someone when the repo men are actually looking for the car?

You didnt make a very good deal and may lose you money as soon as the repoman sees the car. You should make sure the title is free of any leins before purchasing the vehicle. Contact your state title office for details. -Jeff

Can you get a home equity loan while in foreclosure?

Possible, but you would need: Equity in the house above the existing leins and good enough credit to qualify for another loan. Which if you aren't making your existing one, can be a hurdle, especially at any thing like market interest rates. The new second mortgage (Equity lender) will liklely insist the funds be used to make the first loan, and other debts, current. Probably as part of a repayment plan.

What can a bank do if you failed to give them the title from a car you purchased then failed to make payments on you then sold the car and kept the money you still owe 8k on it but Iam disabled from?

They will sue you in court....Win...and garnish any settlements you may be receiving from the government. If they can not garnish any type of payments you receive, they will garnish your tax return, if you get one, or put leins on any property you may own, including other cars, homes, etc. You will be required by law to make monthly payments to the bank, or they have the right to repossess whatever they have a lien on, including that already paid off car, your home, etc.AnswerALSO: by failing to send the title to the car as agreed when you purchased the car, you are technically guilty of fraud, and you could even be charged in criminal court.

You want to buy a truck but owner does not have title how would he go about getting the title or transferring it as soon as possible?

current owner would have to go to the local DMV with proof of identity (driver license) and in some states, proof of vehicle ownership (sales slip or registration) and request a new title. he/she can just tell them that their title was lost/misplaced and they will issue a new title. there is a fee for this so be sure to check with your local DMV to find out how much it costs. they will print the title right then and there and then the current owner will be able to sign the title over the the buyer. (assuming the title is free and clear of any leins)

A friend gave me a truck but won't sigh tiltle. he doesn't want anything to do with the truck now. How do i get it in my name . i have tile in his name.?

Either he signs the title or park it in his driveway and walk away. It's his truck and you're asking for problems because if he doesn't want it he should have no problem signing the ownership. Maybe he's setting you up for a theft charge? You're leaving yourself open to liability by having it. If you can't drive it legally back to him tell him you will call the police and have it removed as you would any vehicle dumped on your property. That way he will be held resposable for impound fees, towing etc. Maybe that will light a fire under him and he will sign the title over to you. Make sure you check out the legal way to do things as something doesn't sound right about the whole situation. Are there any leins against the vehicle? Whats he hiding? Be carefull...

Can mortgage companies find unpaid judgments or other derogatory that have fallen off your current credit report?

Mortgage companies or lenders essentially use two resources to "locate" derrogatory or delinquent accounts such as unpaid or past due accounts, (credit cards, loans secured or unsecured, etc.) judgements, or tax liens. Your credit report is the first one the second set is gathered from the information reported on your title search (which basically desribes where your property is located, when you acquired the property, how you acquired the property, and who you acquired the property from) This information will show any tax leins and/or judgements that you may or may not have. A title search is performed by a company or a attorney ,usually the one closing the loan...if one is required by the state.

What happens to a lien by a creditor if the house forcloses?

in california and most other states. The house is held with a note and deed of trust. The note is like a IOU you promise to pay the bank the money you borrowed. The Deed of Trust says if you don't pay you agree to transfer the house back to the Bank. When you get an Loan to buy the house the Bank makes shure that there is no other leins on house. So the bank is first in line. the next lein is call the second and so on. If you don't pay the house is transfered back to the Bank by the Deed of Trust and then sold for what they can get for it. If it sells for more that what is owed then any money would go to the next lein hold. If there is nothing left then the other lein holders get nothing. Most likely you will have to pay it back.

What can happen to you if you deliberately do not file your tax return?

Nothing good. It is a criminal act and people go to jail for this. Normally before that happens though, they pay the amount owed, plus monster fee's, fines and interest...and accept that they will be suspect for many years to come. Obviously, the Gov't has many ways of collecting whatever it is owed leins, asset seizures, garnishment of wages, and any benefits you may be relying on will not be paid while you owe them. Common sense should say that actions such as this - not even sort of hard to think of - are able to be handled easily and commonly...and very, very effectively. Of course, if you work and have withholding, your probably just not getting refunds and benefits you've actually paid for, so it isn't just a dumb idea, but a bad one too.
