I married an illegal alien in May of 2006 and he was required to return to his birth country to attend and interview. You may do all the paper work here but from what i understand from my experience is they do have to return to their birth country and receive permission to return.

That law has NEVER changed. Not having to leave the country applies ONLY to those who although currently "illegal", entered the US LEGALLY. If a person entered the US ILLEGALLY, the ONLY way to become legal through marriage to a US citizen is to return to the original country and apply for, and get, a waiver. It is IMPOSSIBLE to get this type of waiver in the US for those with illegal entry.
