That law has NEVER changed. Not having to leave the country applies ONLY to those who although currently "illegal", entered the US LEGALLY. If a person entered the US ILLEGALLY, the ONLY way to become legal through marriage to a US citizen is to return to the original country and apply for, and get, a waiver. It is IMPOSSIBLE to get this type of waiver in the US for those with illegal entry.
It is illegal.
How can I help my husband get legal status if he is an inllegal inmigrant. We got married one year ago, I was born here in the United States of America and I need of his help. I had a head trauma in a car accident in 1994 and I have dissabilities. My parents, who have been with me all my life are very old now
Yes, an illegal immigrant from Bulgaria can get married in the United States. An American can choose to marry whomever they want.
I don't have ineugh information to give you an accurate answer. 1. He came with a visa and overstayed? this is very important, because he can adjust his status if he is married to an American citizen. If he came by the border without INS inspection... he cannot do nothing here. Every case is different: Discuss your options with a immigration lawyer a good lawyer (try those immigration recomends they have good prices, payments plans) TO HAVE AN AMERICAN SON DO NOT GIVE ANY RIGHT TO ANY ILLEGAL INMIGRANT, UNTIL THE BABY IS 21 YEARS OLD. GET A LAWYER.
Getting married to an American citizen.
It sounds to me that it would be considered illegal, is one of them illegal, is there money exchanged? be careful.
Yes they can apply - there will be tough questions though.
iam an American sitizen, but my spouse is illegal resident. how can i help her get lawful papers?
yes but it takes lots of time and money
Answer No. He has to apply to your Immigration Department for a visa. Even if you went to Mexico and married there he would still be considered illegal by American Authorities. You would be wise to contact your Department of Immigration and find out what they say.
If you were legally married in the United States, he is an American citizen, whatever his status at the time of your marriage. If he has been arrested for this, the two of you can recover damages for false arrest in a court of law. Get an attorney immediately.
It is not illegal but it may be unwise.
