yes someone can adopt your baby while u are in jail all u have to do is cotact a lawyer or find the parents u want for your child and contact them and let them know your wishes.if you do plan on giving your baby up for adoption can i ask where are u at and i have other things i want to ask but it baceause i know someone who would like to adopt heres my email ribblo@Yahoo.com

Depends on your state and what the parent in jail has done. Just because a parent is in prison does not mean that the child will be put for adoption. If there are 2 parents and the other one care for the child then there is no need for adoption. But if one parent is in prison and the other one is nowhere to be found and the child is placed with a relative that the Court has granted legal guardianship to then the child stay with the relative. If the parent in jail wont terminate their parental rights it can be tricky. It also depends on how long he/she is in for. When they get out of prison the only way to undo a legal guardianship is for the parent to file a petition with the Court explaining the reasons why they are now fit to parent their child. The legal guardian can challenge the request however. The Court would make the final decision as to whether the children can be returned to their biological parent. Unless the parent has done something to hurt the child and would continue to pose a risk, most states wants the child to be reunited with the parents.
