The protections available to criminal offenders through the Bill of Rights that do not currently apply to states are known as unincorporated rights. These rights include the right to indictment by a grand jury and the right to be protected from excessive bail or fines.
The Des Moines Independent School District didn't require students to wear uniforms at that time (if they ever did). The issue had nothing to do with clothing, but with the fact that several students chose to wear black armbands to symbolize their protest of the Vietnam War.
