Congress doesn't "come up with" the form of government. The people do. This is not the monarchies or aristocracies of other world powers. In these United States of America, the people are the kings and queens and the government employees are the servants of the people. Ever seen the movies, or read in books where the guards shout "Stop! In the name of the King!" ; or I arrest you in the name of the King!
Now here you see complaints where the People, or "the State" are the plaintiff's. Because the people make the state, not the other way around. The "state" is a political fiction, that people use to conduct there business.
That's why the employees work under the Civil Service Acts.

The First Continental Congress met in 1774. They did not get much done and, after a time, agreed to adjourn, go home and discover the attitudes of the people, and meet again in 1775. This Second Continental Congress remained in session, adopted the Declaration of Independence, and the Articles of Confederation. After adopting the Articles the Second Continental Congress evolved into the Confederation Congress and remained in business until supplanted by the new government created under the US Constitution, which began in 1789.
