First of all the US is NOT at war with Iraq nor Afghanistan. Congress would have to approve such an action (conscription), and they need justification for it...performing law enforcement operations (arresting/killing terrorists) is not normally justification(s) for drafting people into the military.

The military is (or was) primarily concerned with fighting other standing armies, navies, or air forces. Is the US Military waging a bombing campaign against some nation's capital, trying to make them surrender or come to the peace talks? If the answer is yes, then the US is at war with somebody; and a military draft could be considered to win that war.

But arresting and terminating criminals (terrorists-the global war on terrorism) is a police function. That's why terrorists are not (supposed to be) given POW status. If terrorists receive that "protection" then every criminal in the US will have to be given Prisoner of War protection.

Imagine, a liquer store robber being considered a POW.

It's up to congress to decide who'll they'll induct, when they decide to amend the laws.
