The first 10 Amendments to the US Constitution were all instituted at the same time, as the Bill of Rights of the citizens to protect them against a tyrannical government.

The Tenth Amendment,"The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people" indicates that this is not an exhaustive list of all extant rights and powers, but rather just of federal ones. It relegates all other rights and powers to the states.

In the U.S., education is a constitutional responsibility relegated to individual states. However the federal government has found a way around that -- offer grant money with policy-requirements attached, but without which the schools cannot afford to operate.
