In every state I have lived in, there are no circumstances under which an employer may withhold your final paycheck, or any paycheck, for that matter. It would be helpful to know in which state you worked.
Regardless of the state, no employer is required to hire anyone whom they do not wish to hire. It is not a civil rights issue.
In the state of Arizona an employer is required to provide an employee with their last paycheck within 24 hours of firing them. In certain circumstances where an employer may not be located in the same state there are technicalities in which they can have this law waived to 7 days.
