Yes
No, you can not, unless the custody order is modified by the court.
If she has custody of the kids. Legal custody.
no
im assuming that there wasnt ever any custody case so no you dont need any permission. but if you or him have gone to court for any type of custody then you will need permission
Only if the court papers served to both of you indicate this. If the courts have left you with full custody and no visitation rights for the father then you can move anywhere you want. Marcy
Yes he can. The court will award full custody to the mother or to a legal guardian if necessary. However, the father will be required to pay child support.
what type of mother would want this to happen ..if he is good enough to have joint custoday of his kids then why in the world would you want to give your kids to someone other then him
What do I do when my sons father hasn't been there for my sons in over 11 years and now wants custody?
As long as you have the children 51% of the time. Custody is not an issue regarded by the IRS.
You may have to pay child support to the one who has custody of your children.
If you have a custody order she will have to get permission from you and a judge to take the kids to live in another state. If you don't have a custody order, you need to get one. Make sure you are doing this for the right reasons - to continue to have a relationship with your child/ren. Not just to mess with the ex.
If there is joint custody of the child then the father should be told by the mother where she is going with the child and for how long. If the mother wants to live in another State the courts will have to decide visitation rights. Example: The father has may have the child one or two weeks during the summer; possibly Christmas or alternative Christmas', etc. If the father does not have joint custody then the mother can leave with the child to another State without his permission, but to be fair to the child the father should be informed unless the father has a criminal record; drugs, etc., and is an unfit father.
