Passing on the right is illegal on most roads. As an example, in Michigan, you can only pass on the right if there are three or more lanes going in that direction. Your case would indicate that the driver on the right would have been illegally passing, an indication of fault on their part. However, the person on the left shouldn't turn in to someone, regardless of whether they should be there or not.

If you were legally passing in a marked passing zone and the other vehicle turned left in front of you WITHOUT SIGNALLING THE TURN, I would tend to charge the turning driver with the collision.

IF the driver of the turning vehicle claims that he DID signal his left turn, then YOU would be liable for trying to pass him.

Sounds like this is going to go to court to see who the judge believes, and the insurance companies can battle out the cost of repairs among themselves. Neither of you are going to get out of this without having your insurance rates raised.
