Florida's minimum wage in 2003 was $5.15 per hour. This was in line with the Federal Minimum wage at that time. It later exceeded the Federal Minimum wage in 2005.
Under the FLSA, the federal minimum wage is $7.25 per hour effective July 24, 2009 through the present. Thus, employers subject to the provisions of the FLSA may not pay employees at a rate of less than $7.25 per hour for all hours of compensable time worked. However, many of the states have a higher minimum wage (see below). Minimum Wage State Laws In the U.S., approximately half of the states have minimum wage laws that are identical to the federally-mandated minimum wage. And while many states have laws dictating a higher minimum wage than that required under federal law, some states do not. When state minimum wage conflicts with federal minimum wage, such that a state’s mandated minimum wage is higher, employers must comply with both laws. Otherwise, covered employers must comply with the federal minimum wage laws. For Minimum Wage for Each State Click Here.

2009 Minimum wage for Florida servers is calculated as follows: Florida Minimum Wage $7.21 per hour less Fair Labor Standards Act (FLSA) tip credit of $3.02 for a direct wage owed by employer of $4.19 per hour. Overtime is (7.21 * 1.5) minus $3.02 FLSA tip credit for a total wage of $7.80 per hour plus tips. Effective July 24, 2009 this will change because the federal minimum wage will increase to $7.25 and change the FLSA tip credit. This answer cost me about $10K a couple of years ago.
The minimum wage rate in a state refers to the lowest amount of money a business is allowed to pay it's employees. The minimum wage rate in California,in 2013, is $8 per hour. However, out varies county to county. For example, people that live in a town like Ukiah most likely earn the state mandated minimum wage....but people in San Francisco will earn a higher wage due to the cost of living.
This differs from jurisdiction to jurisdiction. In the United States, federally, the wage and tips have to equal at least minimum wage. Your employer HAS to pay you the difference of your tips from minimum wage, if you didn't end up meeting minimum wage.Example: If minimum wage is $8.00 and after that hour, you only received $6 in tips, then your employer owes you $2.00 for that hour. This can also be figured per shift totals. Exa: $8.00/hr per 8 Hour shift = $64/shift. If you only received $50 in tips that whole shift, then your employer owes you $14 for that shift. In Ontario, Canada, tips do not count towards regular wages. Your employer must pay you at least minimum wage beforetips.
The minimum wage is $7.25, the same as federal minimum wage.
