While what we know as the modern jury system did not really emerge till about the 12th century, and was not codified until the Magna Carta, we can trace some versions of trial by jury back to ancient times. The Bible says Moses recommended a group of elders to pass judgment when there was a dispute (there were also Judges, who seem to have been like mediators); in both ancient Greece and ancient Rome, disputes were also settled by a tribunal or some other group of men. In Greece, for example, some disputes were settled by presenting the evidence to a large group of men -- as many as 500 citizens, and the majority made the final decision. As for why trial by jury came about, perhaps it was a reaction against the original way justice was dispensed-- by one person, usually the eldest male in the village or tribe. If you found his decision arbitrary or unfair, you had no other recourse. Perhaps it was felt that introducing more than one person to render a legal decision would lead to a more just and fair verdict.
