The First Amendment prevents the government from making it illegal to use any word. However, it is also illegal to slander an individual. If you commit slander with malice aforethought, that person can sue you in a court of law. Schools and businesses can have their own rules so that work can get done during their hours of operation.

(in the US) You don't have to prove the you're innocent, they must prove you guilty. Unfortunately you might have to answer the charges and defend yourself against them. However, if law enforcement does not/can not develop probable cause, the case may never even get off the ground.

Stealing is illegal because you are taking something that is someone elses, they worked hard for it and someone is just taking it when they didnt work for it. if you have permission to have it then it is not stealing however.
the reason is because an accused person might not have thrown the merchandise on the floor, so if they police take the evidence it should have the accused fingerprints on it. How do you prove someone took something and then threw it somewhere if you didnt see them, there are no video cameras etc?
