As a matter of fact, one can eat a penguin - but it is ill-advised. Many penguin species are listed as Endangered, so it would be illegal to eat them.

However, penguins have certainly been eaten by starving people in the past. In one particular instance, when explorer of Australia Edward Eyre and his aboriginal companion Wylie were struggling along the shore below the cliffs of the Great Australian Bight in 1841, they came upon a dead penguin on the beach. Wylie had reached such a point of starvation that he did indeed eat the penguin - hide and all. Eyre recorded the incident in his journal.
