Churches differ on whether matrimony is of sacramental rank. In Roman Catholicism, certainly, Matrimony is the 7Th sacrament and is Holy and all like that- and charged with all sorts of often-controversial rules and sub-laws.(In the canon law) In other Christian denominations, while church weddings occur, matrimony is not of sacramental rank. The theory being that only two sacraments could be traced directly back to The Bible, Baptism (John the Baptist) and Commuhion (Last Supper) and the others may well be (Rites) or(ritual practices) but are not sacramental Luther opposed the sacramentalization of marriage, as he felt they were pushing church versus state issues- he argued that this would(Open the door to other vocations having God"s command-such as the Judicature, getting a Sacramental nod, which might lead to a loss of civil liberties- trial by judge (who might be a Monsignor or bishop) and so on. In Germany the Judicial costume in some parts looked more like a relgious habit than the sterotyped black robes worn by US Jurists. They had a Black and white costume- very priestly looking, and odd headgear resembling a full-round or visorless garrison hat- almost maritime. There is an illustration of a German Judge on a series of (occupational) stamps issued in the third reich, looks like some sort of clergyman, definitely not paramilitary or police style-and this in a Police state! The German judges had their own get-up that looked vaguely ecclesiastical, that is waht Luther was afraid of. (did not want priestly judges on the Bench) I beolieve it vilates the canon law for an active Priest to serve as a Judge though he can be a lawyer and many teach law in colleges such as Fordham.
