Neither. It is circumventing the built in restrictions that prohibit you from downloading software from other than the approved source. It is a form of contract violation and, as such, deprives you of legal remedies due to malfunction and it could theoretically constitute a civil violation on that basis alone.
As far as stealing or copying that "unapproved" software, that is a separate issue. There is risk there as well, but the question did not ask that.

And also the insertion (but i think the stealing and insertion go hand in hand). Mikan actually stole from someone in chapter 92 (getting Persona's curse out of Narumi). but she first showed signs of having the stealing Alice in chapters 69-70. That was when she was able to save herself from Persona's curse by "stealing" it out of her body. The stealing Alice isn't really stealing (such as the person who steals it gets the full power of the Alice by getting an another Alice) but just transforming someone's Alice into an Alice stone.
