Paternity Fraud has always been a significant problem, with with advancements in DNA testing, a growing amount of men are learning that they are not the father of their children, especially as regards child support cases. But, only 11 states allow them to enter DNA evidence to prove this, with Kansas being the most recent to turn down the law in legislative session.

unsign the birth certificate

He's Screwed.

This is dependent on the state laws. In 20 states, you can be held responsible, regardless of paternity. Right now in New York, a man is paying child support to his ex whose now married to the bio dad. see links below

You could put the child through a paternity test...but if the child is old enough to recognize you as Dad, then you are ethically required to remain so. Your decision.

If the biological father didnt sign birth cert and has not been around in 3 yrs does that mean you have all parental rights?

Since the biological father did not sign the birth certificate, he has no legal rights to the child unless he wants to pursue them through means of a paternity test which he would have to pay for.

In PA being unmarried parents does the father have to be present to sign the Birth Cert for the baby to have his last name?

My daughter was born in PA, you can name your child anything you want to. Any last name, any first name, it doesn't even have to be the last name of either parent, if that's not what you want. The only thing the father has to sign the birth certificate for is for his name to be on the birth certificate. You can name your child anything you want to! ---- It should be noted that signing the Birth Certificate does not grant the father any rights to the child. It merely acknowledges financial responsibility. Only Arizona and Arkansas has specific laws addressing the rights of unmarried fathers. Arizona grants the same rights as married father, whereas Arkansas specifically says that unmarried mothers have sole control, custody, and decision making as regards the child.

Can i put a man that is not biologically my child's father on her birth certificate if he voluntarilly signs paternitythere is no name father named on her birth cert bio father ordered to pay support?

Too many people involved. Leave the birth certificate as it is. Let the biological father continue to pay child support. If the current man marries you and wishes to adopt the child, then that is another matter. Seek legal advice before doing anything to change the birth certificate. No. This would be fraud unless the child is adopted by your boyfriend.

My husband is not my daughters biological father yet his name is on her birth cert and we are now getting divorced What rights does he have to my daughter?

He would have all of the rights that a biological father has. If he was not the biological father, then his name should not have been put on the birth certificate in the first place, unless he adopted her and the birth certificate was changed.
