Google "Interrogation of a minor PA State Code". Lots of times cops question minors and don't Mirandize them. If your daughter didn't waive her Miranda rights, they've got nothing yet. If she did waive that right, see what the code is in your state. Sometimes it's 14, sometimes 16. Good luck.
A 16-year old can indeed be arrested with or without any parents present. It is irrelevant if there is a parent present or not. The only issue is whether the police: 1) had an arrest warrant, or 2) had probable cause to believe the 16 year old committed a crime
Define what you mean by "question." An officer can speakto a juvenile anytime they want, just like they can speak to any citizen. At school - on the street - in a car during a traffic stop - late at night - in unusual places - etc. A parent need only be present if the juvenile is actually in custody and/or being questioned/investigated for a crime.
