Bankruptcy anywhere is a Federal matter, in a Federal court. Except for minor differences in the way certain Federal Districts view things, for administrative ease mainly, it is the same everywhere.
Chapter 7 is a dissolution.
The day you get your discharge paper. I do caution against that because ANY bad mark after a bankruptcy is taboo and you will not be able to finance anything for a long time.
No. A Chapter 13 that is converted to Chapter 7 must have been ORIGINALLY filed at least 8 years from the prior Chapter 7. So, if you filed Chapter 7 in 2001, then filed Chapter 13 in 2005, you can't wait until 2009 and then convert the 13 to 7 since it was filed within 4 years of the prior 7. In this case, you would have to wait until 2009 and then DISMISS the Chapter 13 and re-file a new Chapter 7 after the 8 years from the prior 7 expired. A Chapter seven will remain on the credit report for ten years. You can always request, legally or informally. But the law states that bankruptcy may remain on your credit report for 10 years from the date of filing. The time limit is strictly adhered to by the credit bureaus for Chapter 7 bankruptcies. The bureaus are much more flexible with Chapter 13. These can, by law, remain for 10 years. But it is customary for them to be shielded from view after 7.
neither.... But they probably will in mid 2009
