Yes, as reimbursement to the State.

He should also make sure the mother has been ordered to pay, which is often overlooked. He can file for custody, but the chances are about 15%.

It depends on if you requested at court for child support. If you did than you have a better chance of not having to pay. If you didn't than you're out of luck!

Do you have to let father see child if he does not pay child support?

Yes. Child support and visitation are two separate issues and parent are not required to pay to see their children. However, you have the right and responsibility to pursue the child support issue. Every non-custodial parent should pay toward the support of their children. The court has many resources for enforcing child support orders. First, you need to make certain you have obtained a child support order. If the father doesn't pay you need to file a motion for contempt of court and stay on top of it. Ask the court's assistance in collecting.

Does the father have the right to know where his son lives if he is paying child support?

No. The mother has the right to know where the child is when she's not in her possession. In fact, the court would require it. What if something happened to the father while the child was with him? It would not be in the child's best interest for the father to be able to keep his whereabouts secret from the mother when the child is with him. Now that's a good recipe to cause strife.

If paying child support does the father have the right to see the child?

The father has the right to see the child whether or not he pays child support. Child Support and Visitation are two separate issues. One does not depend on the other. The parties are required to obey both court orders.

If the mother leaves the country without consent is the father still responsible for child support?

Yes unless he goes to court to have the support order modified. He is responsible for that child regardless of where the mother is. However, he can get a court order to have the child returned. The mother has no right to leave the country without the father's, and court's, consent. Most countries in the Western World have some sort of reciprocal agreements regarding child custody.

If a boy and girl have a baby at 16 and the girl keeps the baby from the boy and then asked for Child support would this child support come from the boy's mother since she is the only parent?

The biological parents pay for their child, not the grandparents. Both of you needs to get jobs and should have done so before the child arrived. When you petition the court for child support the father have establish paternity so they know he is the biological father. He can also petition for visitation and custody since being the biological father, that is his right. Just as it is the child's right to both parents. You can not choose that the father will have no contact with his child. That is up to the court. He has rights just like you. And so does your child.

What can you do if the father is behind on child support and wants to have it modified because child now resides with him?

You should return to court immediately and have the arrears documented. Court ordered arrears do not go away. Even if the child lives with the father he still owes any arrears that accrued while you had custody. He has the right to have the present child support modified but you have the right to collect the arrears. You should also have a visitation schedule. Be aware that the court may issue a child support order against you since the child is now living with the father. You should return to court immediately and have the arrears documented. Payment of child support does not automatically confer a right to visitation. I suggest that you file a motion in the appropriate court to compel visitation.SEE LINKS BELOW

If the father is on the birth certificate what rights does he have?

Two come to mind: the right to petition for visitation; and the right to ask the court to determine his child support obligation.

Does the father have to have visitation rights in order for the mother to get child support?

Child support and visitation rights are two separate issues and they are addressed separately. The father's paternity must be legally established in court if the parents are unmarried and the mother seeks child support. Once paternity has been established, the court will issue a child support order based on state child support guidelines. In addition, once paternity has been established the father has the right to petition for a visitation schedule. If the father fails to pay his child support he is still entitled to visitations. In that case, the mother would need to pursue the child support arrears by filing a motion for contempt of the child support order.

What happens if the father of the child is court ordered to pay child support and refuses?

A court order for child support is not a court order for visitation. These are 2 different issues and needs to be petitioned for separately. If there is a court order for visitation she can not say no without breaking it and can then be reported to the court and even lose custody if repeated. Child support is not a must for visitation. The court cares about the child having the right to both parents so if one can not pay at the moment does not mean they are not allowed to see each other. There is after all many mothers on welfare so technically they can not pay for their child either but they have custody. If there is no court order I suggest you go to court to get one.

If the father pays child support it gives him the right to claim them as dependents?

If the child resides with you and more then half of the cost for the child is supplied by the father. The non-custodial parent can claim the child as a dependent if he has a court order stating thus. Otherwise no.
