In a recent move the Gillard Government has made a deal with the Malaysian Government where they will be sent to Malaysia upon arrival. Gillard condemned the Christmas island process and the deal with Nauru saying that Nauru was not a signatory of the Human Rights convention... though neither is Malaysia.
Not all asylum seekers go through this process however. Only those whom do not formally apply for asylum and attempt to 'jump' to the front of the line.
