Absolutely not, highly recommended to take picture of all vehicles involved, drivers licenses, insurance cards, etc. The more evidence you have the better! Especially if you need to hire an attorney, which is always recommended for a free consultation at the very least.

If it was indeed your fault, then you are better off they drove away in most cases. Contact your insurance, tell them what happened (if you want your car fixed) and file a claim. Your insurance premium may go up, so it all depends on the amount of damage to your vehicle as the whether you get it fixed. It is also recommended to file a police report just in case the owner of the car you hit comes back later to accuse you of the accident.

Sorry but you are at fault in this situation even if a vehicle stops in front of you because in the eyes of the law you must leave enough room between you and the next vehicle to stop at all times. If not you are apt to be cited for following too close in a rear end collision.

Some insurance companies will let you start a claim online but only because they aren't staffed 24 hrs, they will still call you and will want a police report number and your version of what happened. Sometimes even the police don't come out for traffic depending on state and damages but still have to get no for insurance, you will be assigned a rep to work with you to get car taken care of. There may be a deductible; if your car can be driven they will want at least 3 estimates most likely and since the police are slow more may come after about a week. They will determine fault if that applies to your state. There could also be injury claim from the other party etc. which is only a problem if you are at fault in applicable state etc, your driving record/rates could be affected

Disclaimer: I am not an attorney. But that seems to be a thing at the discretion of the Judge, all conditions must be considered, and 'illegally parked' could mean anything from an expired meter to blocking the road. And in Calif, if you are uninsured, regardless, you are at fault because you should not have been on the road. If you rear-end a car at a red light, and that car, just sitting there waiting at the light, is at fault if uninsured. That's why you should carry both uninsured and under- insured on your policy, even when convicted and ordered to pay, they usually don't.

1. Driving under the influence of alcohol or drugs;

3. Driver inattention or being distracted (texting; doing makeup; reading something; having an

animal or unruly child in car; etc....);

4. Driving to closely or tailgating; and,
