Are butterfly knives illegal in Mississippi?

User Avatar

Asked by Wiki User

They aren't, unless you're intoxicated...

Butterfly knives, also commonly known as balisongs, are classified as "gravity knives" rather than "switchblades", and therefore are not made illegal by the same laws and regulations. However, they are considered a deadly weapon in some cases, as they can be deployed using one hand very quickly and are easy to conceal. In some parts of the world they are most definatley illegal, as is the manufacture, sale, lending, or carry of these knives. Germany is a prime example, where any of these actions carries a stiff fine and up to 5 years in prison. In Hong Kong, it is illegal to possess one with a blade of two inches or more, but miniature versions are a popular tourist item. (good luck getting that into your carry-on). In the United States, state laws vary by locale, and how close to the buckle of The Bible belt you reside. In Mississippi, it is legal to own a butterfly knife, and legal to carry one provided it is not concealed and you are not intoxicated. But if you find yourself intoxicated in the state of Mississippi, the last thing you need to be doing is practicing your butterfly knife routine.

Are butterfly knives legal in New Jersey?

User Avatar

Asked by Wiki User

That's sort of a gray area. The answer, I believe, is that they are legal to buy and own but not legal to conceal and carry. One handed opening knives like tactical folders, that open via the use of a thumb stud or thumb hole with a blade that is less than 5" are perfectly legal to own and carry in NJ. However knives that open via a switch or button such as spring assisted folders or switchblades are totally illegal in NJ.

It is possible to buy butterfly knives in Army Navy surplus stores in NJ but such stores do not sell switchblades, so I am assuming it is legal to buy butterfly knives in NJ, otherwise I don't think these stores would risk selling them.

Are butterfly knives legal in Texas?

User Avatar

Asked by Wiki User

Per the Texas Penal Code, butterfly knives (aka balisongs) are legal to own, and as of September 1, 2013, they are legal to carry if the blade (measured from the handle) is no longer than 5.5 inches and only sharpened on one side. The bill that legalized the carrying of switchblades (including butterfly knives) was House Bill 1862 (83rd Regular Session of the Texas Legislature) by Rep. Harold Dutton.

As of September 1, 2015, Texas state law (Texas Local Government Code Section 229.001) also preempts municipalities and counties from creating or enforcing knife ordinances that are more restrictive than state law. The bill that added knives to the list of weapons (a list that already included firearms, air guns, and explosives) that municipalities and counties cannot regulate was House Bill 905 (84th Regular Session of the Texas Legislature) by Rep. John Frullo. This means that, with the exception of federal properties, butterfly knives are now legal throughout Texas.
