Drunk Driving (DWI or DUI)

Drunk Driving refers to the criminal offense of operating a motor vehicle with a blood alcohol content exceeding the legal limit. Drinking and Driving is also called Driving Under the Influence ("DUI"), Driving While Intoxicated ("DWI") or impaired driving. It represents a major cause of automobile accidents and is punishable by fines, penalties and/or imprisonment in many countries. The primary tools that law enforcement uses to combat DWI are the field sobriety test and the breathalyzer.

If I have a DWI can I still get a conceal weapon permit?

It depends on the state. In some states you can. For instance, in Tennessee you can as long as it's been 1 year or more I think.

What is the statute of limitations on a DUI in Tennessee?

NEVER! As I was told in NJ, it's a states right to deny you the right to drive. It is a priv. So, if you never pay your fine, you can never drive in that state.

How long does a wreck stay on your driving record?

According to http://www.senioryears.com/soapbox29.html the answer to how long an accident stays on record is approximately 6(six) years.

An accident is "chargeable" for 3 years after the accident. Some insurance companies will also underwrite, but not charge, for accidents for 5 or 6 years. As far as staying on your "record", the CLUE (Comprehensive Loss Underwriting Exchange) report will show claims activity of any sort for up to 10 years.

What is the reaction time of a drunk driver?

Alcohol doesn't directly slow your reactions. Instead, alcohol makes it more likely you'll miss an important cue and not react at all. Or that you'll fall asleep. Research by Herbert Moskowitz in the 1970s showed that alcohol has little effect on reaction time (RT) in simple tasks, but give the person a task that requires divided attention and the odds they'll screw up and miss something goes up and up the more the person drinks. Driving is a divided attention task: you have to divide your attention between lane positioning, speed, position relative to other traffic and making sure that you follow the right route to your destination. When sober, your eyes flick from point to point 4-5 times per second as you gather information about the road and traffic. The more you drink, the fewer times per second your eyes move, so you're collecting less information about what's going on around you and you're more likely to miss something important that could keep you out of a crash. The drunker you get, the more you develop a sort of "tunnel vision" where you only detect cues in the middle of your visual field and miss the cues at the edges of your field of view. Also, the more you drink, the more your eyes stop moving completely for periods longer than 1 second. It's like the lights are on and nobody's home. The famous "Grand Rapids study" in the early 1960s indicated that if your blood alcohol level is up around the legal limit, you're something like 25-50 times as likely to get into a crash.

Which test may an arresting officer request that you submit to if you are arrested for driving under the influence of alcohol or drugs?

In many states there is no "request" about it. In most (all?) states your signature on the license application is acknowledgement of your acceptance of being directed to undergo a sobriety screening when sufficient probable cause exists to raise a question in the officer's mind that you are under the influence. Refusal of the officers "request"/directive will usually result in an automatic suspension of your driving privileges for a stated minimum amount of time (can vary by state).

Added: To answer your question, officers use Field Sobriety Tests (reciting a portion of the alphabet or walking down a line), breathalyzer tests, and blood tests to test for intoxication or impairment.

DUI manslaughter can be increased if they see fit and can get you a load of jail time up to or exceeding twenty-five years. Other information can be found from your states attorney.

Drunk Driving Statistics?

There are several statistics released by CDC.gov and MADD Online with regard to drunk driving, DUI, and DWI and at a glance it can be inferred that for the past decade, deaths relating to DUI and DWI has dramatically decreased. But it was not clear in the numbers what caused the decline considering that there might be technological advances on safety features of cars manufactured. Overall, the decline is quite a good news but it does not rule out that technology can really assure safety with people still drinking and driving.

Can you become a fire fighter with a DUI?

Re-"Can you become a firefighter with a DUI?"

I am a district fire chief in south Florida. The question isn't a fair question because the answer to this isn't so simple! In actuality it is possible to be hired on with a DUI depending on your circumstances. There are some departments where officers will hire new firefighters whom they personally know before the open process. These departments are usually smaller departments where the city or county regulations and laws arent as strict as larger ones. Dont think this means that its anywhere near easy to get hired on with a DUI on you record... 1st of all 90% of departments wont even consider hiring you when you have a DUI on your record because not only is it an insurance expense for the department but its also a known liability that most departments wont consider taking . At our department here in Florida we wont consider anyone with a DUI or felony conviction no exception and I know for effect the three closest handle thes hiree's the same way! The best advice I could give someone with a DUI or felony on their record that's interested in joing the fire service is that, unless you know a high ranking officer whose word has pull and can guarantee you a job in the department, then your looking down a road that's probably gonna disapoint you after you spend the time and money for school> also find out from your local departments if they do accept interviews with interested Felons or DUI's... hope this helps.
