No, they will however fix or replace it if you're under warrenty. Depending on your carrier however, you may get a discount to upgrade to the Iphone 5 if it can't be fixed. I know AT&T will give a discount if it's broken, not sure about if you're just having problems. I also don't know what other carriers will do.

It may be - that the battery is simply 'dying'. Re-chargeable batteries don't last forever - especially those in mobile phones. You have to make sure that your lock screen orientation option is off. To do that on the current OS, slide up from the bottom of the screen and the light translucent colored control center will open.
