The plan to ban slavery in the territory gained from Mexico was largely encapsulated in the Wilmot Proviso, introduced by Congressman David Wilmot in 1846. This proposal sought to prohibit slavery in any territory acquired from Mexico as a result of the Mexican-American War. Although the Wilmot Proviso passed in the House of Representatives multiple times, it was ultimately rejected by the Senate, highlighting the deep divisions over slavery in the United States at the time. The failure of the Proviso contributed to the increasing tensions that would lead to the Civil War.

It revived the vexing problem of the balance of power within the US Legislature. If new US States created by the acquisition of Alta California and Nuevo Mexico entered as slave states, slavery would be perpetuated for decades. If they entered under the condition of popular sovereignty (which most accepted as the best solution, what would stop them at a later date from changing their constitution to allow slavery). Some wanted a stipulation that slavery would be forbidden in the newly created lands. This was impossible for the South to accept. The 1850 Compromise was like putting a band aid on a gaping wound, it might be better than doing nothing, but it did not solve the problem.
