After India Got freedom from British colonialism, Unfortunately India was splitted in to Pakistan and India. On that time Kashmir was not a part of India or Pakistan. When Pakistan tried to Acquire Kashmir, The King of Kashmir sought help from Indians and they made an agreement with Indian Govt. Because of this we have included Kashmir as a part of India and gave special priveleage (Article 370) to Kashmir.

a special status that a state gives to its people
There is no such thing like 'special status'. It was the brainchild of Gopalaswamy Ayyanger to facilitate a justification for Indian army to put a foothold in Kashmir. With the blessings of Lord Mountbatten the four, Nehru, Patel, Krishna Menon and above all the genius British-Indian bureaucrat V P Menon joined together to hatch a conspiracy, first to hoodwink Sheikh Abdullah and then coerce, intimidate and extract forcebly the controversial Instrument of Accession from Maharajah Hari Singh. That too when he had fled to Jammu with all his possessions.
No they are not under any special status or protection. :)
