Usually, amendments are drafted by association counsel -- a good idea is to gain verbal approval from the required number of owners in advance of commissioning the amendment -- then announced to the membership and voted on by them.
Covenant enforcement -- in any state -- is the responsibility of the association's board of directors. You can find the process in the Bylaws under Enforcement.
Each document details the process to amend or change or modify it. Best practices dictate that you work with an attorney to change any covenant contained in the association's governing documents.
You have raised an interesting issue. First you need to review the original Declaration of Covenants, Conditions and Restrictions to determine if the developer reserved the right for the HOA to make binding changes to that document. If the right to make changes was not reserved then generally the property owners AND the HOA are subject to the terms of the original declaration. If you purchased property in a development that prohibited the parking of motor homes and recreational vehicles you are entitled to the enforcement of that restriction. An unauthorized change would diminish the value of your property and your enjoyment of it. After you have reviewed the original Declaration and determined the right to make changes was NOT reserved, you should make a written request sent by certified mail to the HOA to cite their authority to make changes and request a response within thirty days. If they do not respond then you should consult with an attorney who specializes in real estate law and who has not represented the developer in the past.
