hi i am a 15 yr old mother in west virginia and my boyfriend lives with me and my parents to help me out while i am at school and everything and my mom is a total b*tch to me and yells at me all the time. and i really want out of this out my boyfriend has a job and supporting us very well. So can i anyway get emancipated with out calling social services or anything like that or getting a court date or a lawyer could i just go to my local court house? thank you

No you can not. You have to be 16 to apply and your parents are the ones applying for you, and these requirement have to be filled:

  • The child must be a resident of West Virginia
  • The child has to be at least 16 years of age
  • The child must be living separate and apart from the parents or guardian
  • The child must be capable of supporting himself or herself financially and managing his or her own affairs
  • Each parent or guardian must consent (although there are certain exceptions)
  • Not a ward of the state

You say your boyfriend supports you very well but that is when you live at home. Can he afford paying all bills that comes with a home and a health insurance for you? And him supporting you does not count as a income for you. At the moment the two of you are not even allowed to have sex together since you are below the age of consent even though you already have a child. You can take the yelling, it's a very cheap price considering they are kind enough to help you out with taking care of your child saving you LOTS of money each month for daycare and you get to live under their roof. They did not ask for another baby in the house. Your mom is the one who will always be on your side, remember that. Relationships at your age and with a baby has 4% chance of making it so be nice to your mom, even when she is irritated. Parents always worries about their children and now she worries even more and also about your child. You just have to follow her rules since it's her house.
